Authorisation & Regulation
Malta: Custom House Global Fund Services Limited ("CHGFS") is regulated by the Malta Financial Services Authority ("MFSA"), both as a recognised fund administrator and authorised under a Category 4 license as a Custodian for funds of funds.
Dublin: Custom House Fund Services (Ireland) Limited ("CHI") is authorised by the Irish Financial Regulator under the Irish Investment Intermediaries Act of 1995 (Section 10), is fully SAS70 compliant (see below*) and is the only hedge fund administrator in the world to have been awarded a Moody's Management Quality Rating.
CHI is authorised to carry out business as an administrator of collective investment schemes under Section 10 of the Irish Investment Intermediaries Act of 1995. CHI is also authorised to act as an Irish Payment Agent in regard to certain securities listed on the Irish Stock Exchange.
Guernsey: Custom House Fund Services (Guernsey) Limited ("CHG") is regulated by The Guernsey Financial Services Commission ("GFSC").
CHG is licensed under Category 2 and Category 2 of Section 4 of the Protection of Investors (Bailiwick of Guernsey) Law, 1987 with regard to providing services to Collective Investment Schemes.
Luxembourg: Custom House Fund Services (Luxembourg) S.A. ("CHL") is authorised by the Commission de Surveillance du Secteur Financier ("CSSF") and authorised to act as an administrator, registrar, domiciliation and client communication agent and as a professional in formation and management of companies. (Articles 25, 29, 29.1, 29.2 and 29.5 of the law apply)
The Netherlands: Custom House Fund Services (Netherlands) BV ("CHN") offers Depository (Dutch "Berwaarder") services, which are regulated under the Dutch Financial Markets Supervison Act.
Custom House Fund Services (Chicago) LLC ("CHC") and Custom House Fund Services (Singapore) Pte. Ltd. ("CHS") are not subject to regulation nor required to be authorised.
SAS 70
It should be noted that, although the SAS70 has only been issued to CHI, Custom House has retained an independent auditor to visit its other adminsitration offices and that auditor has confirmed that every office complies with the same procedure and controls as CHI and, as such, they are all SAS70 compliant.
